Mediation

LYNN F. MILLER is a court-approved mediator in civil and chancery cases, and will soon become a court-approved mediator in family cases. Mediation is flexible and confidential.  It gives divorcing spouses a method of settling their differences in a way that helps them focus on their futures and reduces the impact of conflict on their families, especially their children, if there are children.  As a mediator, Lynn F. Miller is neutral; that means she does not give legal advice to either party and cannot act as an attorney for either party.

What she does do as a mediator is point out issues that both parties should be aware of in order to accomplish what they are trying to do.  Mediation is usually voluntary.  Even court-referred mediation can be terminated after the first hour and a half.

Mediation does work, in that it can reduce conflict, especially in family cases.  Mediating divorcing couples are more likely to be satisfied with the process and the results than those who proceed through a litigated divorce.  Mediation usually takes less time and costs less money than litigation.

Mediation's main advantage is that the parties keep control of their own dispute resolution process, and reduces conflict.
